Terms of use

1. Agreement

These terms are an agreement between you and Grace Apps Private Limited, a company registered in India with its registered office at Sr. No. 15/3, Flat No. 303, Lakewood, Ambegaon Budruk, Pune, Maharashtra 411046, CIN U58200PN2026PTC253537. They apply when you use graceapps.in or any application we publish.

By using our website or installing one of our applications, you accept these terms. If you do not accept them, please do not use them. Our Privacy policy forms part of this agreement.

2. Licence to use our apps

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use our applications on devices you own or control, for your own non-commercial use. That is the whole of what you get; we retain everything else.

You may not copy, sell, rent, sub-licence or redistribute our applications; modify, decompile or reverse-engineer them except to the extent the law expressly permits despite this restriction; or remove any notice of ownership from them.

3. Acceptable use

You agree not to use our website or applications to break the law, to interfere with their operation or security, to gain access to accounts or data that are not yours, or to build a competing product from what you learn by probing them.

We may suspend or end your access if you do any of these things, and we will tell you why unless telling you would itself cause harm.

4. Accounts

Most of our applications need no account. Where one is offered — in Grace — you are responsible for keeping your credentials to yourself and for what happens under your account. Tell us promptly at hello@graceapps.in if you think someone else has got into it.

You may delete your account at any time from within the app. Deleting it removes your account data as described in the Privacy policy.

5. Subscriptions and payment

Some applications offer a paid tier. Where they do:

• The purchase is made through the Apple App Store or Google Play, not directly from us, and their terms govern the transaction.
• Prices are shown in your local currency before you confirm, and may differ between regions.
• Subscriptions renew automatically until you cancel. You cancel through your Apple or Google account settings — we cannot cancel a subscription on your behalf.
• Refunds are handled by Apple or Google under their own policies. We are not able to issue a refund for a store purchase. If a store declines your request and you believe the outcome is unfair, write to us and we will do what we can.
• If we change the price of a subscription, existing subscribers will be told in advance and may cancel before the change takes effect.

A free tier, where offered, may have limits on how much you can do with it. We may change those limits for new users, but we will not silently reduce what you have already paid for.

6. Pre-release and beta software

Some of our applications are available as pre-release builds through TestFlight or Google Play testing before general release.

Pre-release software is provided as is, for evaluation. It may be incomplete, it may behave incorrectly, and it may lose data. Do not rely on a beta build for anything that matters — in particular, do not use a pre-release build of HeartBeat as your only record of health information. Features in a beta may change or be removed before release, and a beta may be withdrawn at any time.

If you send us feedback on a beta, we may use it to improve the product without owing you anything for it. You keep ownership of what you write; you simply grant us permission to act on it.

7. Health disclaimer

This section matters more than the others. Please read it.

Grace is a wellness application. HeartBeat is a tool for recording and charting readings you take yourself. Neither is a medical device. Neither is regulated as one. Neither provides medical advice, diagnosis or treatment, and no part of either app should be understood as a clinical opinion.

• Do not use our applications to diagnose or treat any condition.
• Do not start, stop or change any medication because of something an app of ours showed you.
• Readings and charts depend entirely on what you or your device entered. We cannot verify their accuracy.
• Medication reminders are a convenience, not a guarantee. Notifications fail — phones are silenced, batteries die, permissions get revoked. Never rely on a reminder as your only prompt to take medication.
• Stress awareness in Grace is an estimate derived from heart rate data. It is not a clinical measurement of anything.

If you are unwell, seek medical attention. In an emergency, call your local emergency number — do not open an app. Always consult a qualified healthcare professional about your health, and about anything our applications show you that concerns you.

8. NumeroMe disclaimer

NumeroMe produces numerological readings from the details you enter. It is offered for personal interest and entertainment. It is not advice — financial, medical, legal, professional or otherwise — and no decision with real consequences should be made because of it. The calculations follow published numerological traditions; we make no claim that those traditions predict anything.

9. Your content

Anything you create in our applications — reflections, tasks, readings, photographs — belongs to you. We claim no ownership of it.

Where an app stores your content in our cloud so it can reach your other devices, you grant us the narrow permission needed to host and transmit it back to you, and nothing more. We do not use your content to train models, to advertise, or for any purpose other than running the feature you asked for.

You are responsible for keeping your own backups. Where content lives only on your device, deleting the app deletes it, and we cannot recover it.

10. Our intellectual property

Our applications, this website, our names, logos, designs, text and code are owned by Grace Apps Private Limited or licensed to us. Nothing in these terms transfers any of that to you. “Grace Apps”, “Grace”, “Bap”, “HeartBeat”, “NumeroMe”, “CloudFrame” and “EmojiMemory” are our marks.

11. Third-party services

Our applications work alongside services we do not control — Apple Health, the App Store, Google Play, Firebase, connected smartwatches. Your use of those is governed by their terms, not ours, and we are not responsible for how they behave or for anything they do to your data once it is in their hands under your own agreement with them.

12. Availability and changes

We do not promise that our website or applications will be available without interruption or free of defects. We may change, suspend or discontinue any application or feature. If we discontinue something you have paid for, we will give you reasonable notice and deal with you fairly over any unused portion of what you paid.

We may update these terms. Material changes will be notified in the app or by email before they take effect. Continuing to use our applications after that means you accept the updated terms.

13. Liability

To the fullest extent the law allows, our applications and this website are provided as is, without warranties of any kind, whether express or implied.

We are not liable for indirect, incidental, special or consequential loss, nor for lost profits, lost data or lost opportunity, arising from your use of our applications. Where liability cannot lawfully be excluded, our total liability to you is limited to the greater of the amount you paid us in the twelve months before the claim, or INR 10,000.

Nothing here limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited under Indian law.

14. Client work

These terms cover our website and our own applications. Work we do for clients is governed by a separate written agreement covering scope, fees, timelines, intellectual property and confidentiality. Nothing on our website — including anything on the Work with us page — is an offer capable of acceptance or a commitment to any price or timeline.

15. Governing law

These terms are governed by the laws of India. The courts at Pune, Maharashtra have exclusive jurisdiction over any dispute arising from them, and you and we both agree to submit to it.
